Licensed deliverables

After payment of the agreed charges, Sunnyday grants the named customer a nonexclusive license to use the delivered Datapack for the purposes stated in the order. Unless the order limits the term, this license continues for delivered, paid-for material. A separate API or hosted-service access period may end as specified without shortening rights in a lawfully retained delivered copy.

A customer acting for personal purposes may use it for personal research and decision support. A customer acting for business purposes, including an individual business operator, may use it for internal research, engineering and commercial project development, and may share necessary excerpts or copies with its employees, contractors, professional advisers and project collaborators working for it, subject to the same use limits and suitable confidentiality duties. The customer remains responsible for authorized recipients. Wider client delivery, publication or redistribution requires an express permission unless another applicable license already allows it.

Scope and restrictions

You may retain a reasonable backup, annotate or adapt a copy for the permitted purpose, and include necessary attributed excerpts in your internal or project review records while retaining provenance, uncertainty, license and safety notices. Do not resell the Datapack as a standalone product, sublicense it as a competing data service, remove material limitations or claim that synthetic or modeled values are measured or certified.

The license does not transfer the underlying models, software, nonpublic source datasets, trademarks, trade secrets or ownership of Sunnyday’s documentation. No patent license or assurance of freedom to operate is implied. Similar or identical outputs may be produced for others. Rights supplied by mandatory law remain unaffected.

Unless the order expressly grants that right, non-open Datapack material may not be assembled into a bulk training corpus or used to train or fine-tune a model or competing data service. This restriction does not override a separately identified open license or rights that cannot lawfully be restricted.

Open content and customer content

Where a Datapack includes an open record, schema, code or third-party content, its identified license governs that component. For example, a record identified as CC BY 4.0 remains usable under that license; a paid hosted rendering or support service does not make the record exclusive or withdraw its open license. Source and attribution information will be identified in the deliverable or order. We will not grant rights we do not hold.

Your input rights remain yours. Your purchase does not authorize general model training or publication of your content. Any derivative notes you create remain subject to the rights in underlying content.

Validation, termination and remedies

Use remains subject to the Terms’ decision-support and physical-validation requirements. A material license breach may justify termination after notice and a reasonable opportunity to cure, unless law or a serious security risk requires immediate action. Termination affects only rights that can lawfully be terminated; it does not terminate independent open licenses or mandatory rights.

On a valid cancellation and refund for a Datapack, stop using and delete the refunded licensed material to the extent required by the agreed cancellation and law, retaining only legally necessary records.
